DragonLore Games (collectively referred to herein as "DragonLore", "we", "our", or "us") creates original and memorable experiences so that players can have fun, interact with others and take pleasure through our games, applications, websites and online services (collectively "Services"). To let you enjoy our Services, we crafted rules that apply to everything and everyone in our communities: you, other players and ourselves. You agree to this "Terms of Service" by using the Services and Content defined below.
IF YOU ARE YOUNGER THAN 18 YEARS OLD ("Child"), YOU MAY NOT USE THE SERVICES. BY CONTINUING TO ACCESS OR USE THE SERVICES, YOU ARE DEEMED TO HAVE READ AND ACCEPTED THE TERMS OF SERVICE AND YOU CERTIFY THAT YOU ARE AT LEAST 18 YEARS OLD. IF YOU DO NOT AGREE TO THIS TERMS, PLEASE DO NOT USE OUR SERVICES (OR IMMEDIATELY DISCONTINUE YOUR ACCESS OF THE SAME). Our Services are not designed to attract Children. We do not knowingly or wish to collect personal data from such Children. If we learn that a Child is using the Services, we will prohibit and block such use and will make reasonable efforts to delete said Child's personal data stored with us. If you believe that we might have any such personal data, please contact us.
We may change this Terms of Service from time to time without providing notice to users. It is your responsibility to check this page regularly to make note of any changes. By you continuing to use the Services after any such amendment, you agree to be bound by the Terms of Service as so amended.
Our Services include the games, downloadable contents, and other game software (downloaded or streamed), and other software products and online services, including their online functions and other features, together with any of their update and upgrade, the related websites, the live events hosted, the servers, software and the framework through which they are provided to you, currently or in the future, by us, or any one of its subsidiaries or affiliated companies.
These Terms of Service (the "Terms") govern your access to and use of such Services ("user" or "you"). By using the Services and Content (defined below), you accept and agree to comply with these Terms and any particular age and territorial criteria. Additional terms may be applicable to a specific Service, including for example the Terms of Sale of in-game stores and rule(s) of conduct ("Rules of Conduct"). In addition, our Privacy Policy will give you a clear understanding of our use of the personal data we may collect from you during your use of the Services. Please make sure to read all these documents before accessing a Service.
Content (the "Content") means any elements which are part of the Services, including but not limited to information, data, text, messages content, images, links (including links to third party sites), music and sounds, graphics, API, software, other downloadable materials, and/or video sequences displayed therein, documentation, policies, media, in-game items, customization elements, maps, avatars, all gameplay, names, themes, objects, scenery, costumes, effects, dialogues, slogans, places, characters, diagrams, concepts, choreographies, videos, audio-visual effects and domain names.
The Services and Content are licensed to you, not sold. This means we grant you a personal, limited, non-transferable and revocable right and license to use the Services and access the Content, for your entertainment, non-commercial use, subject to your compliance with these Terms.
You are responsible for your Account. Any use of your Account with your password, in particular any purchase of Services, will be deemed to be carried out by you. Change your password on a regular basis. Never share your Account details with anyone and never authorize anyone else to access your account on your behalf. We will never ask you for your password. Contact us immediately of any unauthorized use of your username, password or other Account information.
Do not create multiple accounts, except if we specifically allow it. In such case, you acknowledge that you will close your additional Account upon our request, or that we may terminate your additional Account(s).
The Services may contain forums, information groups, chats or other types of online discussion areas (collectively known as "Forums"). When you use the Forums, you should be aware that your avatar, username and your messages will be public and viewable by any user who visits the Forums (unless you are in a private Forum). You send your messages at your own risk. You have sole responsibility for their submission, publication and dissemination.
Keep these security measures in mind when communicating with other users in the Forums:
Never share information that can be used to identify you in real life. Never accept requests to meet in real life someone you have chatted with, especially if this person asks you to keep your conversations or the meeting a secret, and reject any invitation to join apps or channels outside the Services. Report any behaviour or content you find suspicious or inappropriate, including chats you had with another user that made you uncomfortable. Make sure to talk to someone from your close circle and use the blacklist/mute feature, when available in a Service, to make sure you don’t receive unwanted messages.
We enable you to purchase products via our online store accessible in game. All purchases made are non-refundable. We may limit your ability to purchase products based on multiple criteria including, but not limited to, your age, limited quantities of products available, etc. We may offer periodical promotions for which separate terms apply.
Your access of our Services is made possible through the use of our software. You undertake not to (and shall not, knowingly or otherwise, authorise, allow or assist any third party to) decompile, reverse engineer or otherwise attempt to discover the source code of our Services or any components thereof, except under any specific circumstances expressly permitted by law or by us in writing.
You shall not communicate, republish, upload, post, transmit, edit, re-use, rent, lease, loan, sell, assign, transfer, distribute, make available, license, sublicense or create derivative works or adaptations based on the whole or any part of the Services. You shall not sell, rent, lease, redistribute, broadcast, transmit, communicate, modify, sublicense, transfer, assign any Content to any third party that you may obtain through the Services except as specifically permitted and only in the exact manner provided.
The Services and Content are protected by national and international laws and treaties. Except as expressly set out in these Terms, we, and our licensees and licensors, reserve our respective Intellectual Property Rights in the Services and the Content. "Intellectual Property" are patents, inventions, copyright and related rights, trademarks, trade names, designs, artwork, computer software, database, confidential information (including know-how and trade secrets) and any other intellectual property in whatever format that may be, that are accessible from the Services. Any reproduction or representation of these intellectual properties in any way and for any reason is prohibited without our prior permission.
You shall not use the Services in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this Terms, or in contravention of any applicable law, including infringement of our intellectual property rights or those of any third party in relation to the Services. You shall not remove any watermarks, labels or other legal or proprietary notices included in any Content, or attempt to modify any Content obtained through the Services, including any modification for the purpose of disguising or changing any indications of the ownership or source of Content.
You shall not attempt to, or assist, authorize or encourage others to circumvent, disable or defeat any of the security features or components that protect, obfuscate or otherwise restrict access to any Content or the Services.
You shall not use any automated process, use any kind of scripting software or bots or service to access and/or use the Services. You shall not collect or harvest any personal data of any user of the Services, including but not limited to Account names and profile information through scripts or bots. You shall not attempt to access data that you do not have permission to access.
You shall not reproduce, display or otherwise provide access to the Services on another website, platform, application or server, for example through framing, mirroring, linking, spidering, scraping or any other technological means (including any technology available in the future), without our prior written permission.
You shall not use our Services (or facilitate or support others in doing so) to do or share anything that breaches these Terms, our community standards and other terms and policies that apply to your use of our Services. You shall not use our Services to do anything unlawful, misleading, discriminatory, fraudulent, infringe/breach someone else's rights. You shall not upload viruses or malicious code or do anything that could disable, overburden or impair the proper working of our Services.
We do not guarantee that the Services will be available at all times, in all locations worldwide, and/or on all devices. We do not guarantee that we will continue to offer any Service for any minimum period of time. We reserve the right to terminate all or part of the Services at any time. We reserve the right to modify the prices of the Services, including from a paid Service to a free-to-play one and vice versa. The new price applies only to orders placed after it has come into effect.
We may modify the Content for any reason, at any time, in particular for technical reasons such as updates, maintenance operations or resets to improve or optimize the Services. We may ask or enable you to update the content by downloading software, updates or patches. We may also limit a maximum number of days for which a Content will be stored as part of the Services; limit the volume of messages which can be sent or received by an Account; limit the memory capacity which will be allocated by our servers for your Account; limit the number of times you may access the Services, together with a maximum duration for each access during a given period.
We want to offer you and other users a welcoming, safe and respectful gaming environment, both during gameplay and at any time in our Services. For you and other users to feel part of such a friendly, safe and fair community, you must follow these rules (the "Rules of Conduct"). These rules are non-exhaustive and construe the basis of conduct for any and all users of our Services. Any breach may lead to investigation by our staff and may result in sanctions.
We may apply sanctions, in the event of violation of the Terms and/or of a Code of Conduct. The sanctions are decided on a case-by-case basis, based on multiple criteria, including but not limited to, the seriousness of the violation, the number of violations, and the impact of the violations on the Services, on other users and/or on our representatives. The sanctions may be in the form of a warning, banning of any username, reset of in-game progress, removal of access from particular features on one or multiple Services, temporary ban of your Account from one or several Services, long-term ban of your Account from one or several Services, suspension or force closure of your Account and/or your ability to use one or more Services, or part of the Services.
We may use our own and/or third-party anti-cheat solutions to detect non-authorized behaviours and/or apply corresponding sanctions. We may restrict your access to all or part of the Services should we suspect that you engage in unlawful behaviors inside or outside the Services, in order to keep a friendly, safe and fair environment for our users. In addition, we reserve the right to take legal action on grounds of civil or criminal responsibility in order to stop a breach of your legal or contractual obligations and obtain compensation for our losses. In particular, we reserve the right to prosecute any user who has deliberately damaged or attempted to damage the Services or disrupted the legitimate functioning of the Services or provided assistance for so doing.
You agree to fully indemnify and hold harmless DragonLore Games, our affiliates, officers, employees, owners, agents, service providers, information providers, licensors and licensees, successors and assigns (collectively, the "Indemnitees") from and against any claim, action, proceeding, demand, loss, damage, cost, or liability (including legal fees) which any of the Indemnitees may suffer or suffers in connection with or arising from (a) your breach of this Terms of Service and any terms relating to your use of the Services; (b) your access or use of the Services; (c) any action taken by us either as part of our investigation of any suspected breach of this Terms of Service or as a result of our finding or decision that a breach of this Terms of Service has occurred; and (d) your breach of any rights of any other person. You shall cooperate as fully as reasonably required in the defence of any such claim, action or proceeding. We reserve the right, at its own expense, to assume the exclusive defence and control of any claim or matter subject to indemnification by you.
The provisions of this Clause remain valid and in force after termination of these Terms or of your Account.
You expressly acknowledge that your use of the Services and Content is at your own risk. The Services are supplied "as is", without any guarantees, conditions, warranties or other terms as to their suitability for a particular use or their market value or the absence of interruptions or errors, bugs, viruses or harmful elements, or that errors, bugs, viruses or harmful elements will be corrected and/or your satisfaction.
We hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and any liability for loss or damage suffered in connection with your use of the Services or any related third party service. This includes all losses of any kind (direct, accidental, incidental, consequential and/or indirect), whether in tort (including for negligence or breach of statutory duty), contract and/or misrepresentation (whether innocent or negligent). Nothing above prevents claims for damage to your tangible property.
Your sole remedy in the event of a dispute with us is to seek damages for your losses and cease to use the Services and terminate your Account. When we acknowledge that a Content you purchased is unusable due to our fault, our liability will be limited to providing you with a Content of an equivalent value, chosen by us. Nothing above affects our liability for death or personal injury arising from our negligence, nor our liability for fraud or fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.
Further, nothing in this Terms of Service constitutes any representation or warranty by us as to your rights (if any) to use any content submitted by any third parties, including Third Party Content, all of which representations and warranties are expressly disclaimed.
You may terminate your Account at any time by contacting us. Consequently, an Account termination means cessation of all use of Services and Content. You will lose and we may delete, your profile and the related information you have passed on to us, together with any Content you may have published, uploaded, made available on the Services, notably your username, chat messages, save files, in-game progression related to the Services. In addition, no credit (such as for unused Services, unused in-game currencies) will be credited to you or converted into cash or any other form of reimbursement.
We have the right, in our sole and absolute discretion, to terminate and/or suspend your access to the Services (or any part thereof), where applicable, without prior notice to you at any time for whatsoever reason without refund to you, and are not obligated to disclose the reason behind the termination and/or suspension. Grounds for such termination may include, but are not limited to: (a) a breach of any of the conditions under this Terms of Service; (b) extended periods of inactivity; (c) violation of any applicable law; (d) fraudulent, harassing, defamatory, threatening or abusive behaviour; and/or (e) behaviour that is harmful to other users, third parties, or our business interests. Use of the Services for illegal, fraudulent, harassing, defamatory, threatening or abusive purposes may be referred to law enforcement authorities without notice to you. If you file a claim (under any cause of action whatsoever) either against us, or which in any way involves us, then we may terminate your access to the Services.
Upon suspension or termination of your access to the Services, all rights and/or licences granted to you under this Terms of Service shall immediately terminate. We may remove or discard from the Services any Content associated with you and you remain liable for any obligations you may have incurred under this Terms of Service.
In entering into these Terms, neither party has relied upon and does not rely on any statement, representation, assurance or warranty of any person other than as expressly set out in these Terms.
These Terms and all rules or instructions published online concerning a Service contain the entire agreement between us and you with respect to the subject matter hereof and supersede and cancel any and all prior or contemporaneous oral or written understandings, negotiations and agreements. Nothing in this Terms shall limit or exclude any liability for fraud or fraudulent misrepresentation.
We shall have no liability under these Terms if we are prevented from, or delayed in, performing our obligations or from carrying on our business by acts, events, omissions or accidents beyond our reasonable control, including, without limitation, strikes, failure of a telecommunications network, act of God, war, civil disturbance, riot, pandemic, malicious damage, compliance with any law or governmental order, accident, fire, earthquakes, storms, typhoons, flood, terrorist acts, lockouts or labour disputes or industrial action of any kind or default of sub-contractors.
Your access and use of the Services as well as this Terms shall be governed by Singapore law without regard to its conflict of law rules and you agree that the Singapore courts shall have exclusive jurisdiction over all disputes relating thereto. The United Nations Convention on Contracts for the International Sale of Goods, to the extent applicable, is expressly disclaimed.
